These Terms of Service ("Terms") form a legally binding agreement between you and Astennu LLC ("we," "us," "our"), a Wyoming limited liability company operating the hey.booked platform. By accessing or using hey.booked, you agree to be bound by these Terms. If you do not agree, do not use the service.

hey.booked is an online booking platform that helps businesses manage appointments and allows visitors to discover and book available time slots. The platform includes account management, calendar-based scheduling, and communication features.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. We will make reasonable efforts to notify you of material changes.

You must be at least 16 years old to use hey.booked. By using the service, you represent and warrant that you meet this age requirement. If you are between 16 and 18 years old, you confirm that you have the consent of a parent or legal guardian.

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms or our Acceptable Use Policy.

When using hey.booked, you agree to:

The hey.booked platform, including its design, code, features, branding, and content (excluding user-provided content), is the property of Astennu LLC and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the service for its intended purpose. You may not copy, modify, distribute, sell, or lease any part of the service or its content without our written permission.

You retain ownership of any content you submit through the service (such as business information, booking details, or profile data). By submitting content, you grant us a license to use, display, and store that content as necessary to provide the service.

Certain features of hey.booked may require payment. Payments are processed through Stripe, Inc., our third-party payment processor. By making a payment, you agree to Stripe's terms of service.

All fees are stated in the applicable currency at the time of purchase. Unless otherwise stated, fees are non-refundable. We reserve the right to change our pricing with 30 days' prior notice.

If a payment fails or is disputed, we may suspend your access to paid features until the matter is resolved.

hey.booked is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy or reliability of any information obtained through the service.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the above exclusions apply only to the extent permitted by applicable law.

To the maximum extent permitted by applicable law, Astennu LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of or inability to use the service.

Our total aggregate liability for all claims arising out of or related to these Terms or the service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Astennu LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or related to your use of the service, your violation of these Terms, or your violation of any third-party rights.

You may close your account at any time by contacting us at [email protected]. We may suspend or terminate your account at any time for any reason, including violation of these Terms or the Acceptable Use Policy, with or without notice.

Upon termination, your right to use the service ceases immediately. We will delete your personal data in accordance with our Privacy Policy, except where retention is required by law.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict-of-law principles.

If you are a consumer in the European Union, European Economic Area, or the United Kingdom, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence. You retain the right to bring claims in the courts of your country of residence.

We want to resolve disputes fairly and efficiently. Before filing a formal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

If the dispute is not resolved informally, you and Astennu LLC agree to resolve it through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in English, and the arbitrator's decision will be final and binding.

You and Astennu LLC agree that disputes will be resolved on an individual basis. Class actions, class arbitrations, and representative actions are waived to the maximum extent permitted by law.

Exceptions: either party may bring claims in small claims court if the claim qualifies. Either party may seek injunctive relief in any court of competent jurisdiction for intellectual property infringement or unauthorized access.

If you are a consumer in the European Union, this arbitration clause does not deprive you of the protection of mandatory dispute resolution procedures available under EU law, including the right to bring claims before the courts of your country of residence.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

These Terms, together with the Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and Astennu LLC regarding the use of hey.booked, and supersede any prior agreements.

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice by posting the updated terms with a revised "last updated" date and, where feasible, notifying you by email.

Your continued use of hey.booked after the notice period constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using the service and close your account.

These Terms of Service were originally written in English. Any translated version is provided for convenience only. If there is any conflict or inconsistency between the English version and a translation, the English version prevails and is the only legally binding version.
